Terms of Use

By accessing or using Rock My Auction ("the Platform"), you agree to be bound by these Terms of Use. If you do not agree to all of these terms, you must not use the Platform. These terms constitute a legally binding agreement between you and Rock My Auction.

We reserve the right to modify these terms at any time. Material changes will be communicated via email or in-platform notification at least 14 days before taking effect. Your continued use after changes constitutes acceptance.

To use Rock My Auction, you must meet the following requirements:

• You must be at least 18 years old or the age of majority in your jurisdiction
• You must provide accurate, current, and complete registration information
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activity that occurs under your account
• You must not create multiple accounts or share your account with others
• We reserve the right to suspend or terminate accounts that violate these terms

Binding Bids

All bids placed on Rock My Auction are legally binding offers to purchase. When you place a bid, you are committing to pay the bid amount plus any applicable fees if you are the winning bidder. Bid retraction is only permitted in exceptional circumstances as determined by our support team.

Bid Increments & Reserves

Minimum bid increments are set by the system to ensure fair auction progression. Sellers may set reserve prices — auctions will not be awarded to bids below the reserve. The presence of a reserve is clearly indicated on the auction listing.

Prohibited Bidding Practices

The following bidding behaviors are strictly prohibited and may result in immediate account suspension:

• Shill bidding — bidding on your own items or colluding with others to inflate prices
• Bid manipulation — using automated tools to gain an unfair advantage
• Bid shielding — placing high bids with the intent to retract before auction ends
• Non-payment — consistently winning auctions without completing payment

As a seller on Rock My Auction, you agree to:

• Provide accurate, honest, and complete item descriptions including condition, provenance, and any defects
• Upload clear, authentic photographs that accurately represent the item
• Ship sold items within the timeframe specified in your listing (default: 5 business days)
• Use proper packaging to ensure items arrive in the condition described
• Not list counterfeit, stolen, illegal, or prohibited items
• Honor all completed auction sales — refusing to sell to a winning bidder is a violation
• Respond to buyer inquiries and support tickets in a timely manner
• Maintain a minimum seller rating threshold as required by the platform

Sellers who repeatedly violate these obligations may face listing restrictions, fund holds, or permanent account suspension.

Buyer Payments

Winning bidders must complete payment within 48 hours of auction close unless otherwise stated. Accepted payment methods include credit/debit cards and platform wallet balance. Failure to pay may result in account restrictions and negative feedback.

Seller Fees

Rock My Auction charges sellers a commission on completed sales. The current fee structure is displayed on your seller dashboard and may be updated with 30 days notice. Fees are deducted automatically before payout.

Wallet & Payouts

Your Rock My Auction wallet stores your available balance from sales. Withdrawals are processed according to the payout schedule displayed in your wallet settings. We may hold funds temporarily for fraud review or dispute resolution.

Refunds & Chargebacks

Refunds are processed on a case-by-case basis through our dispute resolution process. Excessive chargebacks or fraudulent refund requests may result in account suspension.

The following items and content are strictly prohibited on Rock My Auction:

• Counterfeit, replica, or knockoff goods
• Stolen property or items of questionable provenance
• Weapons, explosives, or hazardous materials
• Illegal drugs, controlled substances, or drug paraphernalia
• Human remains or body parts
• Items that promote hatred, violence, or discrimination
• Items that infringe on intellectual property rights (trademarks, copyrights, patents)
• Wildlife products prohibited under CITES or local law
• Any item that violates applicable local, national, or international laws

Listings of prohibited items will be removed immediately. Repeat violations will result in permanent account suspension and may be reported to law enforcement.

All content on the Rock My Auction platform — including the logo, design, software, text, graphics, and user interface — is the intellectual property of Rock My Auction and is protected by copyright, trademark, and other intellectual property laws.

Users retain ownership of content they upload (photos, descriptions) but grant Rock My Auction a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute such content in connection with the Platform.

If you believe your intellectual property rights have been infringed by a listing, please submit a report through our reporting system or contact our support team with details of the alleged infringement.

We encourage buyers and sellers to resolve disputes directly through our messaging system. When direct resolution is not possible, Rock My Auction provides a structured dispute process:

• Step 1: Open a support ticket detailing the dispute with relevant evidence
• Step 2: Our moderation team reviews the case and contacts both parties
• Step 3: A resolution is proposed (refund, partial refund, return, or dismissal)
• Step 4: If either party disagrees, an escalated review is conducted by a senior moderator

Dispute decisions are made in accordance with the evidence provided and these Terms of Use. Rock My Auction's final decision is binding. We strive to resolve all disputes within 14 business days.

Rock My Auction serves as a marketplace platform connecting buyers and sellers. We are not a party to the transactions between users and therefore:

• We do not guarantee the quality, authenticity, or legality of items listed by sellers
• We are not responsible for the conduct of any user, including fraudulent activity
• We are not liable for any indirect, incidental, or consequential damages arising from platform use
• Our total liability to you for any claims shall not exceed the amount of fees you paid in the 12 months preceding the claim
• We do not warrant that the Platform will be uninterrupted, error-free, or secure at all times

This limitation applies to the fullest extent permitted by applicable law. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above limitations may not apply to you.

You may close your account at any time through your account settings. Upon termination:

• Outstanding bids on active auctions may still be binding
• Pending transactions must be completed before account closure
• Wallet balance will be paid out according to standard payout procedures
• Your data will be handled in accordance with our Privacy Policy

Rock My Auction reserves the right to suspend or terminate any account that violates these Terms, engages in fraudulent activity, or poses a risk to the platform or its users. We will provide notice and an opportunity to appeal except in cases of severe or illegal violations.

These Terms of Use shall be governed by and construed in accordance with applicable laws. Any disputes arising from these terms or your use of the Platform shall be resolved through the dispute resolution process described above before pursuing any legal action.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
